TL;DR

Must be of legal age in your jurisdiction to use. While the software itself cannot do any harm, slapping too hard can. If you break your MacBook, that's on you. SlapMac's Anti-Theft Mode is a deterrent, not a security service — if your MacBook gets stolen, the developer is not responsible. If the loud siren causes a public disturbance, noise complaint, fine, or any other unpleasantness, that's also on you. If SlapMac doesn't work as expected on your device, we'll refund you. Just reach out to refund@slapmac.com. We might ask for a short video showing the issue.

1. Acceptance of Terms

By downloading, installing, or using SlapMac ("the Software"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Software.

2. Age Requirement

You must be of legal age in your jurisdiction to use SlapMac. Some soundpacks contain content not suitable for minors. By purchasing or using the Software, you confirm that you meet the minimum age requirement under applicable law in your country or region. The developer assumes no responsibility for use of the Software by minors and disclaims all liability arising from underage access.

3. Description of the Software

SlapMac is a novelty macOS application that detects physical impacts to your MacBook using the built-in accelerometer and plays audio responses. As of v1.4, the Software also includes an optional "Anti-Theft Mode" that uses the same accelerometer to detect motion while the screen is locked and triggers a loud siren, captures a photo from the front camera, and overrides the lockscreen wallpaper. The Software is provided for entertainment and personal-deterrent purposes only and is not, and is not represented to be, a security system, alarm system, monitoring service, or theft-recovery service.

4. Hardware Disclaimer

You use SlapMac entirely at your own risk. The Software encourages users to physically strike their MacBook. The developer expressly disclaims any and all responsibility for damage to your hardware, including but not limited to:

  • Cracked, broken, or scratched displays
  • Damaged hinges, enclosures, or internal components
  • Malfunctioning keyboards, trackpads, or sensors
  • Voided manufacturer warranties
  • Data loss resulting from physical impact
  • Any other physical or functional damage to your device

While the software itself cannot do any harm, slapping can. By using SlapMac, you acknowledge that striking a computer is inherently risky and that you are solely responsible for any consequences that arise from doing so.

5. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Software, including but not limited to damages for loss of profits, data, hardware, goodwill, or other intangible losses, even if the developer has been advised of the possibility of such damages.

In no event shall the developer's total liability exceed the amount you paid for the Software.

6. No Warranty

The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that the Software will be uninterrupted, error-free, or free of harmful components.

7. Assumption of Risk

You expressly acknowledge and agree that the use of the Software involves the deliberate application of physical force to your device. You assume all risk of damage, injury, or loss that may result from using the Software as intended or otherwise.

8. Disclaimer of Liability for Social and Professional Consequences

The developer shall not be held liable for any social, professional, reputational, or personal consequences arising from the use of the Software in any setting, including but not limited to workplaces, educational institutions, public spaces, or private gatherings. Without limiting the generality of the foregoing, the developer expressly disclaims responsibility for any adverse outcomes including but not limited to termination of employment, disciplinary action, loss of professional standing, damage to personal or business relationships, ejection from premises, or public embarrassment resulting from the audible, visual, or behavioral effects produced by the Software. You acknowledge that you are solely responsible for exercising appropriate judgment regarding when, where, and in whose presence you choose to operate the Software.

9. Photosensitivity Warning

The Combo Hit voice pack includes a screen flash effect. If you have epilepsy, photosensitive seizures, or any other condition that may be triggered by flashing lights, do not enable the screen flash feature. The developer expressly disclaims any and all liability for adverse health effects resulting from the use of visual effects in the Software. By enabling the screen flash feature, you acknowledge that you do so at your own risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless the developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Software or violation of these Terms.

11. License

SlapMac grants you a personal, non-transferable, non-exclusive, revocable license to use the Software on devices you own or control. You may not redistribute, reverse-engineer, decompile, or create derivative works based on the Software.

12. Intellectual Property

The SlapMac name, logo, brand colors, visual design, website content, audio assets, and all associated materials are the exclusive intellectual property of the developer. All rights not expressly granted in these Terms are reserved.

You may not copy, reproduce, imitate, or create derivative works of the SlapMac brand identity, including but not limited to the logo, color scheme, website design, marketing materials, or audio content, without prior written consent from the developer. Unauthorized use of any SlapMac intellectual property will be pursued to the fullest extent of applicable law.

13. Open Source Acknowledgments

SlapMac incorporates the following open source components:

  • spank by Tai Groot — licensed under the MIT License. Original inspiration for SlapMac's slap detection concept.
  • LidAngleSensor by Sam Gold — licensed under the Apache License 2.0. Used for lid angle detection functionality.

Full license texts for all open source components are included with the Software distribution. The use of these components does not imply endorsement by their respective authors.

14. Refund Policy

If the Software fails to function on your supported device, email us at refund@slapmac.com and we will work to resolve the issue or provide a refund. No refunds will be issued for hardware damage resulting from use of the Software. We might ask for a video of the issue to help diagnose the problem.

15. System Requirements

SlapMac requires macOS 14.6+ (Sonoma) or later running on Apple Silicon (M1 chip or later). The developer is not responsible for issues arising from use on unsupported hardware or operating system versions.

16. Privacy

SlapMac does not collect, transmit, or store any personal data from your device. All accelerometer data is processed locally on your device and is not sent to any server. The Software does not use analytics, telemetry, or tracking of any kind.

17. Marketing Communications

When you purchase SlapMac, your email address is collected as part of the transaction. By completing a purchase and not requesting a refund, you agree that the developer may use your email address to send occasional marketing communications, including but not limited to product updates, new features, promotions, and related announcements.

Every marketing email will include a clear and easy way to unsubscribe. Once you unsubscribe, you will no longer receive marketing emails, though you may still receive transactional emails related to your purchase (e.g., refund confirmations).

The developer will not sell, rent, or share your email address with third parties for their own marketing purposes.

18. Changes to These Terms

The developer reserves the right to modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the updated Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.

20. Anti-Theft Mode Disclaimer

SlapMac's Anti-Theft Mode is a novelty deterrent, not a security service.It is not a substitute for insurance, professional monitoring, AppleCare, Apple's Find My, physical security measures, or common sense. Activating Anti-Theft Mode does not create any duty of care, monitoring obligation, or guarantee of any kind on the part of the developer.

Theft, loss, and recovery. The developer makes no representation or warranty that Anti-Theft Mode will prevent, deter, detect, interrupt, document, or assist in the recovery of any theft, loss, or unauthorized use of your MacBook or its contents. The developer expressly disclaims any and all liability for:

  • Theft, loss, damage, or unauthorized use of your MacBook, accessories, or peripherals
  • Loss, disclosure, or compromise of any data, files, credentials, or accounts on the device
  • Failure of the alarm, camera, wallpaper override, iCloud upload, or any other Anti-Theft feature to trigger, function, complete, or persist for any reason, including but not limited to operating system updates, permission changes, hardware faults, low battery, the device being powered off, the device being placed in a Faraday bag or otherwise shielded, network unavailability, or the thief disabling, uninstalling, reinstalling, or wiping the Software or the device
  • Any decision by you, law enforcement, or any third party to act or not act on information produced by the Software
  • Any cost, expense, or loss incurred attempting to recover a stolen or lost device

Public disturbance, noise, and third-party reactions. Anti-Theft Mode produces a loud audible siren and may cause significant noise, alarm, distress, or disruption to people and animals nearby. You are solely responsible for choosing when, where, and in what setting to arm the Software. The developer expressly disclaims any and all liability for any consequence arising from the Software being triggered — intentionally, accidentally, or by a third party — including but not limited to:

  • Noise complaints, public disturbance citations, fines, penalties, or other legal or administrative action by neighbours, building management, landlords, hotels, airlines, schools, employers, venues, transit operators, or any governmental authority
  • Eviction, lease termination, suspension, expulsion, ejection from premises, or denial of service
  • Hearing discomfort, startle response, panic, distress, injury, or any health effect (physical or psychological) experienced by you or any third party — including bystanders, children, pets, service animals, or persons with sensory or medical conditions — exposed to the alarm
  • Property damage, accidents, slips, falls, dropped objects, or vehicular incidents caused by a startle reaction to the alarm
  • Damaged personal, professional, or business relationships, reputational harm, public embarrassment, or social media consequences
  • Confrontation, altercation, retaliation, or violence directed at you, your device, or any third party as a result of the alarm or photo capture

False alarms. Motion-based detection is inherently imperfect. The Software may trigger on vibrations, movement, transport, cleaning, pets, children, building activity, or other benign causes. The developer is not liable for any consequence of a false alarm, including any of the consequences listed above.

"Selfie of Shame" and image capture. When triggered, Anti-Theft Mode may capture still images using the built-in camera and store them on the device and, at your option, in your iCloud Drive. You are solely responsible for ensuring that your use of this feature complies with all applicable laws in your jurisdiction and in any jurisdiction where the device is located, including without limitation laws governing image capture, recording, biometric data, surveillance, privacy, data protection (including the GDPR, CCPA, and equivalent regimes), workplace monitoring, and the rights of minors. The developer is not the data controller, processor, or custodian of any image captured by the Software and disclaims all liability for the capture, storage, transmission, disclosure, sharing, publication, or misuse of any such image, whether by you or by any third party.

Lockscreen wallpaper override. The Software may temporarily replace your lockscreen wallpaper while armed. The developer is not responsible for any visual content displayed via this feature where you have configured a custom image, nor for any consequence of that content being seen by any third party.

Lawful use. You agree to use Anti-Theft Mode only on devices you own or are expressly authorized to protect, only in environments where you have the legal right to record images and produce loud audio, and only in a manner consistent with all applicable laws and regulations. You are solely responsible for any unlawful use of the Software, and you agree to indemnify the developer in accordance with Section 10.

By enabling Anti-Theft Mode, you acknowledge and accept all of the foregoing risks and disclaim, on your own behalf and on behalf of anyone claiming through you, any and all claims against the developer arising out of or related to Anti-Theft Mode.
